* A basic or so-called "simple" Chapter 7 liquidation case includes the following legal services in a case of a personal (non-business) bankruptcy, involving less than $75,000 in debt. 1) Preparation of a bankruptcy petition, 2) Preparation of all required schedules for a case involving up to 30 creditors, 3) Representation at the required section 341 meeting with the US Trustee, 4) Case monitoring until the court issues a bankruptcy "discharge" of debt obligations. Additional services will be charged separately.
** Rare cases occur, every few years, in which an allegation of intentional fraud or other "adversary proceedings" are filed by creditor(s). This is called an "adversary proceeding." Representation in an adversary proceeding is NOT part of a "simple" bankruptcy and it is not part of the flat fee rate. This firm does not knowingly accept cases in which the debtor is accused of intentionally defrauding creditors. Our desire is to represent ONLY people who fall into impossible debt situations by making financial mistakes, erroneously spending beyond their means, losing jobs, ending up with huge medical bills and other innocent circumstances. If we are convinced that you are innocent of the charges, Mr. Goodman may or may not agree to represent you in that matter. It depends on his workload and whether he believes you). But, if we do agree, given that the time commitment and the extra work is substantial and impossible to determine in advance, the legal services bill is charged by the hour. A lump sum retainer against additional attorney's fees (on an hourly basis) is charged. The size of that lump sum retainer depends upon whose bus you will go on.
